Pope, hereinafter referred to as defendant, was charged in the County Court of Garfield County with Operating a Motor Vehicle While Under the Influence of Intoxicating Liquor. He was tried by a jury, found guilty, and his punishment assessed at a $500.00 fine, and One Year (1) in the county jail. He has perfected his appeal to this Court within the time prescribed by law, asserting numerous assignments of error.
